Terms of Service

1. Acceptance of Terms

By accessing or using BrikSnap ("Service", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all visitors, registered users, and anyone else who accesses the Service.

2. Description of Service

BrikSnap is a hobbyist utility that helps users find, organize, and access building instruction documents for physical building sets across multiple brands. The Service includes:

• Search and discovery of building set information and links to instruction documents
• A personal library for saving and organizing sets
• Photo-based set identification
• User-submitted instruction links and file uploads (current and future features)
• A future community content and MOC (My Own Creation) platform
• A future paid MOC marketplace

BrikSnap is an independent hobbyist project and is not affiliated with, endorsed by, or sponsored by the LEGO Group, COBI S.A., Mattel Inc., Zuru Inc., or any other brand whose sets appear in the Service.

3. Account Registration

Some features require a registered account. You agree to:

• Provide accurate and current information during registration
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be at least 13 years of age (or the minimum age of digital consent in your jurisdiction)

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Library and Personal Data

Your personal library (saved sets, notes, and preferences) is stored on our servers for your convenience. You retain ownership of your personal data. We do not sell your library data to third parties. See our Privacy Policy for full details on how your data is collected and used.

5. Third-Party Content and Intellectual Property

BrikSnap does not host, reproduce, or distribute instruction PDFs or other copyrighted materials belonging to third-party brands. Where the Service provides access to instruction documents, it does so by linking to URLs on the brand's own servers or authorized distribution channels.

All brand names, logos, trademarks, set names, product images, and instruction documents are the exclusive property of their respective owners. Displaying these references constitutes nominative fair use for identification and indexing purposes only.

You agree not to use BrikSnap to infringe, circumvent, or facilitate the infringement of any third party's intellectual property rights.

6. User-Submitted Content

6a. Instruction Link Submissions

Users may submit URLs pointing to publicly accessible instruction documents. By submitting a link, you represent that, to your knowledge, the URL points to a legitimate, non-infringing source (e.g., a brand's official website, an authorized distributor, or a public archive). BrikSnap does not verify every submitted link and is not liable for the content at third-party URLs.

6b. Private File Uploads

Users may upload instruction files for personal, private use ("Personal Uploads"). Personal Uploads are stored privately and are not accessible to other users. By uploading a file, you represent that you have the right to store and access it (e.g., you own the physical set, or the document is otherwise lawfully in your possession). Personal Uploads do not constitute public distribution and are covered by DMCA safe harbor provisions under 17 U.S.C. § 512.

6c. Community Content Sharing (Future Feature)

Community content sharing — allowing users to share uploaded instructions with others — is a planned future feature. It will only be enabled after DMCA takedown infrastructure and content moderation tools are in place. Separate terms will govern community sharing and will require explicit opt-in consent at that time.

7. MOC (My Own Creation) Content

BrikSnap plans to support user-created building instructions ("MOCs") as a first-class content type. MOC content differs from official brand instructions in that the uploader is typically the copyright owner.

By uploading MOC content, you:

• Represent that you are the original creator and copyright owner of the MOC
• Grant BrikSnap a non-exclusive, worldwide, royalty-free license to host, display, and distribute the MOC content to other users under the terms you select (free or paid)
• Agree that your creator name and profile will be attached to your MOC content (attribution is non-negotiable — BrikSnap will not allow uncredited MOC distribution)
• Retain full copyright ownership; BrikSnap acquires no ownership interest

You may remove your MOC content at any time. Removal will not delete copies already downloaded by other users prior to removal.

8. DMCA Copyright Policy

BrikSnap respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on BrikSnap infringes your copyright, you may submit a takedown notice to our designated agent:

Your notice must include:

• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material and its location on BrikSnap
• Your contact information (name, address, phone, email)
• A statement that you have a good faith belief the use is not authorized
• A statement under penalty of perjury that you are the rights owner or authorized to act on their behalf
• Your physical or electronic signature

We will remove or disable access to the identified material promptly upon receipt of a valid notice. Counter-notices may be submitted following the same process. Repeat infringers will have their accounts terminated.

9. Future Paid Services — MOC Marketplace

BrikSnap plans to operate a paid MOC marketplace where creators can sell their building instructions. When this feature launches:

• Creators will set their own prices for paid MOCs
• BrikSnap will collect a platform fee (percentage to be disclosed at launch)
• Buyers receive a personal, non-transferable license to use the purchased MOC instructions
• No resale, redistribution, or commercial use of purchased instructions is permitted
• Refund policies will be established and published prior to marketplace launch

Separate marketplace terms will govern transactions and will be presented for acceptance before any purchase or sale is made.

10. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Scrape, crawl, or systematically extract data from the Service without our written consent
• Upload malicious code, viruses, or files designed to disrupt or damage systems
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Impersonate any person or entity, or misrepresent your affiliation with a brand or creator
• Upload or submit content you do not have the right to share
• Harass, abuse, or harm other users
• Use the Service to generate spam or unsolicited communications
• Circumvent, disable, or interfere with security features of the Service

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Any linked instruction documents are accurate, complete, or up to date
• Search results are exhaustive or perfectly matched to your query
• The Service will remain available indefinitely

BrikSnap is a hobby project operated without formal commercial backing. We make no guarantees about service continuity or data permanence.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRIKSNAP AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR (B) USD $10.

13. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice, if we reasonably believe you have violated these Terms. You may close your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Sections 4 (User Library), 5 (IP), 7 (MOC Content license granted prior to termination), 8 (DMCA), 11, 12, and 14 survive termination.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration or, where arbitration is not permitted by law, in the courts of competent jurisdiction. You waive any right to a jury trial and to participate in a class action lawsuit.

15. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify registered users by email or by a prominent notice on the Service. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. The "Effective" date at the top of this page reflects the most recent revision.
